Interested parties may appear and be heard at the hearing or file written notice of approval or objection with the Planning and Development Director or City Clerk prior to the hearing.  Any person who decides to appeal any decision made by the Board or Council, with respect to any matter considered at such hearings, will need to request a record of the proceedings and, for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based per Florida Statute 286.0105.  Community Development Code Sec 4-206 states that party status shall be granted by the Board in quasi-judicial cases if the person requesting such status demonstrates that s/he is substantially affected.  Party status entitles parties to personally testify, present evidence, argument and witnesses, cross-examine witnesses, appeal the decision and speak on reconsideration requests, and needs to be requested and obtained during the case discussion before the CDB.

An oath will be administered swearing in all persons giving testimony in quasi-judicial public hearing cases.  If you wish to speak at the meeting, please wait to be recognized, then state and spell your name and provide your address.  Persons without party status speaking before the CDB shall be limited to three minutes unless an individual is representing a group in which case the Chairperson may authorize a reasonable amount of time up to 10 minutes.  The Community Development Board will review the case and make a recommendation to the City Council for final disposition.

Five days prior to the CDB meeting, staff reports and recommendations on the above requests will be available for review by interested parties between the hours of 8:30 a.m. and 4:30 p.m., weekdays, at the City of Clearwater, Planning and Development Department, 100 S. REQUEST FOR RELEASE OF FUNDS

On or about December 7, 2016the City of Clearwaterwill submit a request to the United States Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) and HOME Investment Partnership Program (HOME) federal funds under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383), the Stewart B. McKinney Homeless Act of 1987 (P.L. 100-77) and the National Affordable Housing Act of 1990 (P.L. 101-625), all as subsequently amended, to undertake projects as follows:

Project Number 1

Project Title:  The Kimberly Home
                      Acquisition and Demolition

Location:  North Greenwood NRSA

Purpose: Acquisition/Demolition of a structure to provide suitable parking.

Project Number 2

Project Title:   North Garden Avenue Redevelopment
Acquisition and Redevelopment

Location:   North Greenwood NRSA

Purpose:  Acquisition/Construction of affordable homeowner-occupied housing units.

FINDING OF NO SIGNIFICANT IMPACT

The City of Clearwater has determined that the projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of Clearwater, 112 S. Osceola Avenue, Clearwater, FL 33756 and may be examined or copied weekdays 8:00a.m. to 5:00p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Clearwater, Housing Department, 112 South Osceola Avenue, Clearwater, FL 33756. All comments received by December 6, 2016 will be considered by the City of Clearwater prior to authorizing submission of a Request for Release of Funds (RROF). Comments should specify which Notice you are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Clearwater certifies to HUD that William B. Horne, II, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Clearwater to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Clearwater’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Clearwater; (b) the City of Clearwater has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD administration office at Jacksonville Office, Region IV, 400 West Bay Street, Suite 1015, Jacksonville, Florida 32202. Potential objectors should contact HUD to verify the actual last day of the address of that office.

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING THE ZONING ATLAS OF THE CITY BY ZONING CERTAIN REAL PROPERTY LOCATED ON THE EAST SIDE OF OWEN DRIVE APPROXIMATELY 630 FEET NORTH OF SR 590, WHOSE POST OFFICE ADDRESS IS 1749 OWEN DRIVE, CLEARWATER, FLORIDA 33759, UPON ANNEXATION INTO THE CITY OF CLEARWATER, AS LOW MEDIUM DENSITY RESIDENTIAL (LMDR); PROVIDING AN EFFECTIVE DATE.

Thursday, November 17, 2016 before the City Council (1st Reading), at 6:00 p.m.
Thursday, December 1, 2016 before the City Council (2nd Reading), at 6:00 p.m.

All public hearings on the ordinances will be held in Council Chambers, 3rd floor of City Hall, 112 South Osceola Ave, Clearwater, Florida. The ordinance and complete legal description of the property proposed for annexation, by metes and bounds, may be inspected or obtained at Official Records & Legislative Services, located at City Hall. Interested parties may appear and be heard at the hearing or file written notice of approval or objection with the Planning and Development Director or City Clerk prior to the hearing. Any person who decides to appeal any decision made by the Board or Council, with respect to any matter considered at such hearings, will need to request a record of the proceedings and, for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based per Florida Statute 286.0105.
